1. Definition of Terms
1.1 User
The term “user” refers to any person, computer, software, program or tool that visits www.surfing-the-world.com and any URL that belongs to www.surfing-the-world.com. The user may also be referred to as “you” within the GT&C.
1.2 Accommodation
The term “accommodation” refers to any surf camp, hostel, hotel, surf school or other type of accommodation or service provider which offers its services on www.surfing-the-world.com. An accommodation provider may also be referred to as “supplier” within the GT&C.
1.3 Surfing-the-World.com - STW
STW is the abbreviation of the website www.surfing-the-world.com and any URL that belongs to www.surfing-the-world.com. The actual name of www.surfing-the-world.com is Surfing-the-World.com, which is abbreviated as STW. STW operates a platform for information related to surf accommodations and surf travel in general.
2. Acceptance of GT&C
Your use of this website is subject to your irrevocable acceptance without modification of these General Terms and Conditions of use ( the ‘GT&C’) and you agree to use this website in accordance with and subject to these GT&C . The GT&C as set out in this document constitute the entire agreement between you and Surfing-the-World.com. If you do not read or accept these GT&C , do not use this website. By accessing any part of the Surfing-the-World.com‘s website, you consent to be bound by these GT&C .
Surfing-the-world.com operates as a provider of information related to surf-specific accommodations and their services.
3. General Terms
STW offers a platform for information concerning surfing-related accommodation providers (”suppliers”) and their services. STW does not offer any services to users other than providing information on a website. The supplier may provide travel services upon request. Reserving or booking accommodation or other services creates a legally binding contract between you and the supplier, on the supplier’s Terms and conditions. Any claims and obligations resulting from the accommodation or travel service contract exist directly and solely between you and the accommodation provider.
Any contract for accommodation services made by a user of STW is made between the user and the supplier. The supplier is responsible for providing the accommodation and other related services to the user. Though STW would like to ensure that the supplier does provide those services to you, under no circumstance will STW warrant, guarantee or otherwise assume any responsibility for the legal obligations or service standards owed by suppliers to you or others at any time.
4. Subscription Types for Suppliers
4.1 Types
Currently we offer two different subscription options to suppliers. These are the “FREE Subscription” and the “PRREMIUM Subscription”. They differ in the way the suppliers are able to manage their accommodation listings on STW. Generally, the PREMIUM Subscription offers many more features than the FREE Subscription. To subscribe for one of the two Subscriptions, please follow the process of registration as described below.
4.2 Process of Registration
- Register as a regular user on www.surfing-the-world.com
- Fill out the “Register Accommodation” Form, where you choose your subscription plan.
- We will review your accommodation and after approval, we will automatically register your property as a Free Subscription and send you an email with all further information and payment requirements for an upgrade to a PREMIUM Subscription.
- After we receive your payment and any other necessary information, your subscription will change to a PREMIUM Subscription. All features of the PREMIUM Subscription are listed at Features.
4.3 FREE vs. PREMIUM Subscription
FREE Subscription: Allows you to list your accommodation for free on STW. There will be no charge for listing your accommodation without any further notice. Users contact you using a ticketing system. Once a user makes an inquiry, an email will be sent to you by us or our ticketing system. You will not receive the user’s contact information, and the response will be made through STW. You must respond within two working days. You are not allowed to post any kind of contact information which guides the user directly to you or your accommodation, If you fail to follow these GT&C, your listing will be banned from STW for an unspecified time.
PREMIUM Subscription: Accommodation providers choosing the PREMIUM Subscription are able to respond to contact inquiries directly. All contact information will be provided to you. However, the initial contact request will be made via STW. STW will only receive a copy of the initial contact request of the user.
The PREMIUM subscription period (6 month or 12 month) starts with the date we change your listing from FREE to PREMIUM. This is done after we receive the payment on which we agreed. You will receive a notification via email once the account type changes. By the end of the subscription period, you will receive an email requiring you to renew your account and make the respective payment. Your subscription will automatically downgrade to a Free Subscription if you fail to repay the requested amount by the end of the chosen subscription period.
Whether you are on FREE or PREMIUM Subscription you are not allowed to post a direct link to your website, no matter what subscription you are on.
5. Payments
All payments for the PREMIUM Subscription are to be made in advance. Payments can be made via bank transfer or Paypal.
6. No Liability in Credit Card or Debit Card Transactions
Currently STW provides no services involving credit card transactions. By using a redirected link to one of our partners, you might need to use a credit card on the redirected site. STW takes all reasonable efforts to ensure that all debit made through the site are secure. However, if unauthorized charges appear on your debit card statement for any card used on this website at any time during or after you make your reservation, conduct your transaction or disclose your card details on this website, STW shall not be liable or responsible in any way in respect of any damage or loss of whatsoever nature suffered by you arising from or in any way connected with said use, transaction or disclosure, subject only to any statutory rights which you may have.
7. Modification of GT&C
STW reserves the right to change these GT&C as well as the contents of its website for any reason, at any time.
8. Insurance
STW encourages you to take out personal travel insurance for yourself and all persons traveling with you. Such insurance could include, but is not limited to, baggage insurance, travel cancellation, penalty insurance and health care insurance. Some suppliers may require insurance as a condition of your using their services.
9. Age and Financial Responsibility
By using STW, you confirm that you are of sufficient legal age to use this website and to create binding legal obligations and contracts for any liability you may incur as a result of the use of this website. You understand that you are financially responsible for all uses of this website by you and those using your log-in information.
10. Copyright
STW intends that the information, content, graphics, text, sounds, images, buttons, trademarks, service marks, trade names and logos ("Materials") contained in this website should be protected by copyright, trademark, database right, sui generis right and other intellectual property laws under applicable national laws and international treaties. STW or its licensors (as the case may be) retain all right, title, interest and intellectual property rights in and to the Materials. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, Materials, software, products or services obtained from this website. Other than expressly provided herein, nothing in these GT&C shall be construed as inferring by implication or otherwise any license or right under any copyright, trademark, database right, sui generis right or other intellectual property or proprietary interest of STW, its licensors or any third party. Any persons breaching any of this provision will be prosecuted.
11. Liability for Links
Our site contains links to third-party websites, which are provided for your reference only. We have no influence whatsoever on the information and content provided by these third-party websites and offer no guarantee, nor accept any liability, concerning its reliability, legality or suitability. The content of such third-party sites is the responsibility of the respective owners/providers. STW does not control such websites and is not responsible for their contents. The inclusion of hyperlinks on this website to such other websites does not imply any endorsement of the material on such websites or any association with their operators.
We make every effort to keep the information on our website current, but accept no liability whatsoever for the content provided. Pursuant to §7 par. 1 of TMG (the German Tele-Media Act), the law limits our responsibility as a service provider to our own content on surfing-the-world.com pages.
According to §§8 to 10 of TMG, we are not obligated to monitor third party information provided or stored on our website. However, we shall promptly remove any content upon becoming aware that it violates the law. You consent that STW and all its internet service providers will not be held liable for any damages resulting from the user’s use of, or inability to use, STW. Furthermore, the user agrees to waive or indemnify STW against all claims based on contracts, torts or other grounds, so far as the user is legally capable of doing so.
STW can be used by all users as is. STW cannot guarantee that this website or the server hosting it is free from defects including, but not limited to, viruses and spyware. STW accepts no liability whatsoever for any infection by computer viruses, or exposure to bugs, tampering, unauthorized access, intervention, alteration or use, fraud, theft, technical failure, error, omission, interruption, deletion, defect, delay, or any event or occurrence beyond its control, which corrupts or affects the administration, security, fairness and the integrity or proper conduct of any aspect of this website.
